JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No.233/2019, Police Station Mahila Thana, District Srigangangar, for the offences under Section 376(2)(n)(h) of IPC.

(2.) Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

(3.) Learned counsel for the petitioner submits that the prosecutrix is closely relative to the present petitioner. She is a divorced lady and the petitioner was having relationship with her for last more than one and a half years. The F.I.R. has been lodged after a delay of one year from the date of incident. The charge-sheet in the case has been filed. The conclusion of trial will take sufficiently long time, therefore, it is prayed that the petitioner may be enlarged on bail.
