JUDGEMENT

(1.) Appellant/complainant has filed the appeal challenging the order dated 20.12.2019 passed by the trial court, whereby, respondents no.2 to 5 were acquitted of the charges framed against them.

(2.) Respondents no.2 to 5 had faced trial under Sections 302 , 201 , 120-B Indian Penal Code, 1860 in FIR No.62 dated 18.07.2011 registered at Police Station Datwas, District Tonk.

(3.) Prosecution case was set in motion on the basis of the statement of complainant-Ramjeevan. As per the complainant, his daughter-in-law Santi had gone to the fields on 23.01.2011 for grazing goats. However, the goats returned home at about 4/5.00 p.m., but Santi did not return home. Thereafter, complainant searched for his daughter-in-law and at about 7.30 p.m. the dead body of Santi was recovered from the well. On the basis of the statement of the complainant, formal FIR was registered. After thorough investigation of the case, negative final report was submitted by the Investigating Agency. Thereafter, on the basis of protest petition filed by the complainant, cognizance was taken by the Magistrate and the case was later committed to the Court of Sessions for trial.
