JUDGEMENT

(1.) Learned counsel for the petitioners submitted that all the petitioners were appointed as Computer Operator-Man with Machine. Learned counsel submitted that the petitioners were appointed initially on contract basis through placement agency and later on they were employed through Rajasthan Medical Relief Society.

Learned counsel submitted that the respondents now have issued an order dt. 21st May, 2020 whereby they intend to proceed as per the circular dt. 30th April, 2018 and further intend to replace the present petitioners by changing their status from contractual employees to employ through service provider.

(3.) Learned counsel further submitted that this Court in S.B. Civil Writ Petition No. 953/2017 (Pankaj Kumar Upadhyay & Ors. Vs. State of Rajasthan & Ors.) vide order dt. 20th March, 2017, has declared action of the State to be illegal by changing the status of the petitioners to be engaged through placement agency. Learned counsel also refers to an order dt. 3 rd April, 2019 passed by this Court in S.B.Civil Writ Petition No. 6204/2019 (Jaswant Dagdi and Ors. Vs. The State of Rajasthan & Ors.), which has finally been decided by this Court in S.B.Civil Writ Petition No.13206/2019 (Chanchal Khurana & Anr. Vs. State of Rajasthan & Ors.) & other connected writ petitions decided vide common order dt. 21st August, 2019.
