JUDGEMENT

(1.) This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C. seeking regular bail in connection with F.I.R. No. 40/2020 registered with Police Station Paniyala, District Jaipur, for the offence punishable under Section 363 , 366 and 376 of IPC.

(2.) Heard learned counsel for the accused petitioner through video conferencing and perused the record.

(3.) It has been contended by learned counsel for the accused-petitioner that charge-sheet has been filed under Sections 363 , 366 and 376 of IPC in this case, which has been placed on record. Trial of the case may take time. It is also submitted that looking to the statements of prosecutrix under Sections 161 and 164 of Cr.P.C, she travelled with the accused- petitioner on motor cycle, in a bus and other public transports to Jaipur and then to Indore, where they lived in a rented house for some days. She never protested and never made any complaint to any person, who happened to meet her during transport in public vehicles and while she was in public places. Similarly, the witness Kailash S/o Cheetu Bagri has also stated in his statement recorded under Section 161 of Cr.P.C that accused-petitioner and prosecutrix lived in a room as husband and wife. Even no complaint was made to the witness by the prosecutrix.
