SANJU KANSARA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) These miscellaneous petitions have been preferred by the petitioner-complainants seeking a direction for fair investigation of four separate FIRs, viz., FIR No. 52/2019 registered the Police Station Boranada, Jodhpur, FIR No. 74/2019 registered at the Police Station Shastri Nagar, Jodhpur, FIR No. 73/2019 registered at the Police Station Shastri Nagar, Jodhpur and FIR No. 66/2019 registered at the Police Station Basni, Jodhpur, lodged by the petitioners with almost similar allegations. Grievance of the petitioners is that the Investigating Officers are not conducting fair investigation in these matters.

As per the factual report submitted on record by the learned Public Prosecutor, the complainant Yash Kansara S/o late Mr. Brijlal was asked to appear for investigation, on which, he replied that the lawyer representing them would talk to the Investigating Officer. The alleged accused have been asked to submit the original documents, but they have not responded till date.

(3.) In this background, it is hereby directed that the Investigating Officer concerned shall conduct thorough and stringent investigation into the FIRs mentioned above. All required steps, which are expected in a case with allegations of fraud and forgery including examination of documents by FSL shall be undertaken by adopting a fair procedure of investigation.
