LOKESH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This Criminal Misc. Bail Application has been brought underSection 439of Cr.P.C. seeking regular bail in connection with F.I.R. No. 331/2019 registered with Police Station Malakheda, District Alwar, for the offence/s punishable under Section/s 332, 353, 307/34 ofI.P.Cand 3/25 ofArms Act.

(2.) It has been submitted on behalf of the accused petitioner that he has been falsely implicated in this case. This is a case of no injury. Co-accused Suresh, Banti @ Mahesh and Asam, have been released on bail by Co-ordinate Benches of this Court and petitioner's case is not different of them. As per the FIR co- accused Asam was arrested on spot and allegation for the offence under Sectjon 3/25 ofArms Acthas been levelled against him only, but he has also been granted benefit of bail. Hence on theground of parity, present accused-petitioner is also entitled to the benefit of bail.

(3.) Learned Public Prosecutor has opposed the bail application.
