JUDGEMENT

(1.) Petitioner has filed this second bail application under Section 439 of Cr.P.C.

(2.) F.I.R. No. 130/2019 was registered at Police Station Sarthal District Baran for offence under Section 8/15 of NDPS Act.

(3.) It is contended by counsel for the petitioner that petitioner is 73 years old person who was not present at the time of recovery. It is also contended that the seal was destroyed but later on the same seal was used in another F.I.R. The poppy husk is said to have been recovered from three bags. Proper procedure was not followed. Contents of bag was mixed and then the sample was taken.
