DINDAYAL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Heard learned counsel for the petitioner through Video Conferencing and learned Public Prosecutor, present in the Court.

(2.) Learned counsel for the petitioner submitted that the statement of the prosecutrix recorded under Section 164 Cr.P.C. clearly reveals that the prosecutrix was having an affair with the accused petitioner and she was taken on motorcycle by the accused petitioner to a place belonging to the friend of the accused petitioner.

(3.) Learned counsel further submitted that the said statement also reveals that the petitioner wants to get married with the present prosecutrix on attaining the age of marriage of 18 years on 23.11.2019 and as such the petitioner has been falsely implicated in the present case.
