SURESH BAIRWA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.403/2020 registered at Police Station Sanganer Sadar District Jaipur City South for the offence(s) under Section(s) 376 of IPC.

(2.) It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case with regard to some family dispute between the parties pertaining to immovable property. He submitted that there are material contradictions in the statement of the proseuctrix in her statement recorded under Section 161 CrPC as well as under Section 164 CrPC. He submitted that the petitioner is in custody since 08.08.2020, charge-sheet has been filed, the matter has been compromised between the parties and prays for his release on bail.

(3.) Learned Public Prosecutor has opposed the bail application.
