ARVIND Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No. 514/2019 registered at Police Station Sadar Hindon, District Karauli for the offence(s) under Sections 323 , 341 , 325 , 307 , 302 and 34 IPC.

(2.) Learned counsel for the petitioner submits that there is no overt-act alleged against the accused-petitioner and only general allegations have been levelled against several persons. Learned counsel further submits that a cross case of the same incident is already pending against the complainant. Learned counsel submits that co-accused Gajendra Singh has already been released on bail by the co-ordinate Bench of this Court vide order dt.29.05.2020 in S.B. Criminal Misc. Bail Application No.1692/2020. Learned counsel further submits that case of the petitioner is based on similar footing. From the statement of the eye-witnesses, namely Balram and Sahdev, it is evident that Jaibo @ Jaivind had inflicted injury on the head of Bharat with a stick. Hence, the petitioner be released on bail.

(3.) Learned counsel for the complainant and learned Public Prosecutor have opposed the bail application.
