JUDGEMENT

(1.) This second bail application has been filed by way of criminal appeal is under Section 14A of SC/ ST Act 1989 against the order dated 7.3.2020 passed by RJS(District Judge Cadre)Special Judge SC/ST(PA) cases, Sawaimadhopur whereby the bail application filed by the appellant has been dismissed.

(2.) Brief facts of the case are that an FIR No.67/2019 was registered at P.S. Batoda Sawaimadhopur for the offences 147, 148, 149, 323, 341, 324, 325, 308 IPC and Section 3-2(VA) SC/ ST Act . During the course of investigation, the accused appellants were arrested. Thereafter they moved the bail application before the trial court, who vide impugned order dismissed the same. Hence this appeal has been filed on behalf of the appellant.

(3.) It is submitted that after the first bail application was withdrawn, the charge sheet has been filed and from the statement which have been recorded u/s 161 Cr.PC ., the allegation of causing sharp bones as on Rajesh who is said to be having sword while the accused petitioners are alleged to having Sariya and Hockey respectively. The grievance injury is on the left hand of the injured person which is not attributed to the accused petitioners.
