JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.165/2020 registered at Police Station Bhankrota District Jaipur for the offences under Section 8 , 21 and 22 of Narcotic Drugs & Psychotropic Substances Act , 1985.

(2.) Heard learned counsel for the petitioner through video conferencing.

(3.) Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case. The accused- petitioner is running a medical shop and license to this effect has been granted in favour of the accused-petitioner. The allegation against the accused-petitioner is that he was having 2140 tablets of Alprazolam and 472 capsules of Tramadol. He further submits that the small quantity of tablets Alprazolam is 5 gram while the recovered tablets is waiving to 1.07 gram only. It is also submitted that recovered capsules of Tramadol is waiving 23.60 grams while the small quantity prescribed is 5 gram and commercial quantity is 250 grams and such the recovered capsules of Tramadol is much less then commercial quantity. He further submits that he was alleged to have not presented the bills regarding the medicine found in his possession. He was licensed medical shopkeeper. Accused-petitioner is in custody since 27.04.2020 and completion of trial will take time. He prays for acceptance the bail application and he be released on bail.
