JUDGEMENT

(1.) The present Misc. Petition has been filed by the petitioner challenging the order dt. 5th June, 2020 passed by Special Judge, POCSO Court wherein appeal filed by the petitioner, against the order dt. 26th May, 2020 decided by the Juvenile Justice Board No.1, Jaipur, has not been entertained while treating the appeal to be not maintainable, as the said Court does not have jurisdiction to decide the appeal.

(2.) Mr.Deepak Chauhan, learned counsel for the petitioner submitted that brief facts of the case revealed that the petitioner was made an accused in the FIR No.142/2019 for alleged offences said to be committed under Section 376(2)(n) IPC and underSections 3/4 of POCSO Act.

Learned counsel submitted that the petitioner was arrested and lodged in the Juvenile Justice Board, Jaipur Metropolitan, Jaipur and the petitioner through his father (Natural Guardian) filed an application under Section 12 of Juvenile Justice Act. Learned counsel submitted that the Juvenile Justice Board No.1, Jaipur vide order dt. 26th May, 2020 rejected the bail application and the petitioner being aggrieved with the said order preferred an appeal under Section 101 of Juvenile Justice (Care and Protection of Children) Act , 2015 (hereinafter 'the Act of 2015').
