The only prayer made in this writ petition is that the learned Industrial Tribunal has erred in passing the impugned order dated 10/3/2008 and while allowing the representation through lawyer in the Industrial Tribunal to one of the workmen Om Prakash, learned Tribunal has rejected the said prayer for the other two workmen Bhanwar Lal and Bheru Lal even though common reference order was made for all the three workmen as to whether their termination w.e.f. 24/6/2006 was valid or not.

Having heard the learned counsels, it appears to this Court that no cogent reason as been assigned in the order by the learned Tribunal as to why representation through lawyer could not be allowed to Bhanwar Lal & Bheru Lal, who are similarly situated to workman - Om Prakash, who has been allowed such representation and common reference has been made for the aforesaid dispute.
(3.) Under the provisions of Section 36(4) of the Industrial Disputes Act, 1947, the Learned Tribunal can grant such permission to be represented through lawyer.
