MAHENDRA SINGH Vs. STATE OF RAJASTHAN

Decided On January 06, 2010
MAHENDRA SINGH Appellant
V/S
STATE OF RAJASTHAN Respondents

JUDGEMENT

(1.) Heard learned counsel for the petitioner.

(2.) The petitioner has challenged the transfer order dated 18.9.2009 on the ground that he has been transferred because of the influence of the District President of a political party who recommended his transfer vide letter dated 3.9.2009. That plea was not accepted by the Rajasthan Civil Services Appellate Tribunal and the petitioner's appeal was dismissed vide order dated 1.12.2009.

(3.) The alleged letter is dated 3.9.2009 and the transfer order issued on 18.9.2009 contains the list of names of about 829 persons. Therefore, the Tribunal rightly observed that the transfer of the petitioner cannot be attributed to the action of one person. At this juncture, it will be relevant to mention here that the person against whom allegation of influence has been levelled, was not impleaded as party either in the appeal or in this writ petition.
