JUDGEMENT

(1.) Counsel submits that controversy raised herein has been decided by this Court in Naveen Kr. Sharma & (16) Ors v/s. State and Ors. (CWP -4728/2008 & six cognate cases)vide judgment dt.01/12/2009 clarifying the position ad infra:

Without going into merits, writ petition is hereby disposed of with the direction to the petitioner to make representation and if made, respondent authority is directed to pass appropriate orders assigning reasons taking note of what has been observed in CWP -4728/08 (supra) and communicate the decision within two months from the date of submission of his representation to the petitioner. However, it is made clear that if vacancies are not available, petitioner may be informed with complete details.

(3.) In the light of what has been observed (supra), writ petition stands disposed of.
