JUDGEMENT

(1.) MR . Umesh Vyas for the petitioner.

(2.) AGGRIEVED by the orders dated 05.07.2010 and 03.08.2010 passed by the Additional District Judge (Fast Track) Bandikui, Headquarter Dausa, whereby the learned trial Court has closed the evidence of the petitioner, the petitioner has approached this Court.

(3.) IT is the contention of the learned Counsel for the petitioner that the petitioner should be given ample opportunity to present his defence. On 05.7.2010, since the petitioner was ill, he could not appear before the Court and was not in a position to inform his counsel about his inability to appear before the Court. Despite the fact that he had submitted ample evidence to prove his inability, vide order dated 03.08.2010 his application under Section 151 C.P.C., has been dismissed.
