JUDGEMENT

(1.) COUNSEL for Petitioner submits that controversy raised herein has been decided by this Court in Naveen Kr. Sharma and (16) Ors. v. State and Ors. (CWP -4728/2008 & six cognate cases) vide judgment dt.01/12/2009 clarifying the position ad infra:

(2.) HOWEVER , Government Counsel submits that no vacancy is available against which Petitioner can be considered for appointment. There is no such material on record by which inference can be drawn that vacancies are not available.

(3.) THIS Court has already observed that if vacancies are available, the same be filled up in the order of merit. Individual merit of writ Petitioner has not been examined by this Court. In the light of what has been observed (supra) in CWP -4728/08, instant writ petition stands disposed of. However, it is made clear that if vacancies are not available, Petitioner may be informed with complete details . No order as to costs.
