JUDGEMENT

(1.) AS a consequent to the land acquisition proceedings initiated as per provisions of the Land Acquisition Act, 1894, the land measuring 9.11 bighas under tenancy of the petitioner was acquired by the State of Rajasthan for establishment of an air strip. An award for a sum of Rs. 6,20,750/ - was passed and the compensation determined was availed by the petitioner.

(2.) AS per the petitioner the land was acquired in the year 1997 but air strip has yet not been established, as such the purpose for acquiring the land has been frustrated. A claim, thus, is made for de -acquisition of the land.

(3.) IN the circumstances referred above, I am not inclined to interfere with the matter at this stage. Accordingly, the petition for writ is dismissed. The petitioner may pursue his cause before the Collector -cum -Land Acquisition officer, Sriganganagar as he is already doing by submitting a representation, copy whereof is available on record as Anx.8.
