JUDGEMENT

(1.) Heard learned counsel for the petitioner.

(2.) The petitioner's grievance is that the respondent no.4 challenged his transfer order dated 23.10.2009 before the Rajasthan Civil Services Appellate Tribunal, Jodhpur Bench by preferring appeal. However, instead of setting aside the order dated 23.10.2009, the Tribunal vide order dated 5.11.2009 directed the respondent no.4 to submit his representation to the competent authority within 15 days with a direction to the competent authority to decide the same within a period of one month from the date of order.

(3.) According to learned counsel for the petitioner, the said representation yet has not been decided by the competent authority and one month's time has already passed long back.
