This petition has been filed under Sec. 482 Crimial P.C. with the prayer that the order of anticipatory bail granted on 7.6.2000 by learned Additional Sessions Judge, Pali may be modified and the said order may be extended till the regular bail application is filed and heard by the trial court and also further for fifteen days to file regular bail application before this Court. Learned counsel for the petitioner submitted that the police is going to submit a charge-sheet and in view of the decision reported in ( Smt. Gattu Bai Vs. State of Rajasthan, 1999 (1) RLW page 272 )' the period of anticipatory bail may be extended under the inherent powers of this Court under Sec. 482 Crimial P.C.
(2.) I have considered the contentions put forth on behalf of the petitioners. It is true that the period already fixed upto the filing of result of the investigation can be extended as laid down by Honourable Supreme Court in the pronouncements on this subject. The same view has been taken in Smt. Gattu Bat Vs. State of Rajasthan (supra). Therefore, the petitioners can move the same court i.e. learned Additional Sessions Judge, Pali for extension of the period because the anticipatory bail order has been passed on 7.6.2000 by that Court. Therefore, in the circumstances, it will not be appropriate to exercise the power under Sec. 482 Crimial P.C. by this Court. But the learned Additional Sessions Judge, Pali may extend the period after hearing the parties on the application filed by the petitioners in accordance with law and in the light of the above referred judgment.
