(1.) THE petitioner was denied admission into the PTET course on the ground that the BA (External Course) Degree is not equivalent to the usual B. A. Degree granted by the other Universities, since the B. A. (External Course) degree consists of only one year course, which is not the usual pattern existing in the other Universities in India including the MDS University which has refused admission to the petitioner on this ground. THE sole ground of the petitioner's challenge is based on the U. G. C. circular as contained in Annexure-5, which states that one sitting B. A. Degree Course, which means one year Degree Course, will be treated as valid and equivalent to B. A. Degree for all other higher Course. However, the said circular does not disclose any reason whatsoever for taking such a decision. Even if some order has been passed by a body like the University Grants Commission, the same cannot be accepted unless it is approved by the University since, the power to grant recognition or to refuse recognition lies within the domain of the University and the State Government. THE University cannot be questioned for not recognising a particular degree, when it is brought to my notice that the B. A. (External Course) Degree consists of only one year and thus is not on par with the Bachelor's Degree granted by other Universities and why a preferential treatment is given to the B. A. (External Course) Degree by the U. G. C. is not quite clear. Hence, I see no reason to entertain this writ petition. Accordingly, it stands dismissed. .
