JUDGEMENT

(1.) THIS is a petition under Section 561 -A Cr. P.C. for questing criminal proceedings, pending in the court of the Chief Judicial Magistrate, Srinagar.

(2.) THE complainant -respondent instituted a criminal complaint under Section 406 R. P. C. against the petitioners with the allegation that the accused were entrusted with some boxes of fruit, which they misappropriated and refused to return. The magistrate took cognizance of the case and issued process against the accused.

(3.) AN application have been moved in this court for quashing the proceedings on the ground that no case of criminal breach of trust is made out against the accused.
