JUDGEMENT

(1.) These two writ petitions involve common questions of law and fact and will be decided by one common judgment.

(2.) THE facts, giving rise in these petitions may be briefly summarized as follows:

UNDER a scheme of the Government of Jammu and Kashmir to recruit probationary Assistant Engineers on a stipend of Rs. 200 per month, the petitioners were recruited as probationary Assistant Engineers to be appointed against available vacancies. The petitioners were recruited through the Public Service Commission on the basis of their merit and ability. The Public Service Commission forwarded a list of 25 candidates by which according to the petitioner Chaman Lal, he was placed at No. 3 while according to the petitioner Jawahar Lal in the other writ petition he was placed at No. 6. In pursuance of the recommendation of the Public Service Commission the petitioners were appointed as probationary Assistant Engineers and directed to undergo practical training for two years after which they were to be appointed as Assistant Engineers against available vacancies after successful completion of their period of training. The order appointing them as probationary Assistant Engineers under training is order No C - 18/G dated 30th September 1959 This order was passed in pursuance of the Council decision No. 1227 dated 24 -9 -1959 as mentioned in the order it self. The order of Shri Chaman Lal Mattu. Petitioner runs thus.
