JUDGEMENT

(1.) The petitioners applied under the RBA category for the post of ReT Teacher in Middle School Ladeyote. The name of the petitioners figured at Sr. No. 1 and 2 in the select panel. Subsequently however, it appears that the Chief Education Officer, Rajouri directed the preparation of the panel, keeping in view the provisions of Government Order No. 635 of 2010 dtd. 4/8/2010. The respondents, accordingly, prepared a panel, in which name of private respondent No. 5-Nadeema Chowdhary was shown to have been selected. The said respondent No. 5 was selected under the Schedule Tribe category. It is this select panel that has been impugned in the present writ petition.

(2.) The grievance of the petitioners is that the Government Order No. 635 infact provides for 100 percent reservation and would thus be violative of the petitioners' fundamental rights under Article 16 of the Constitution of India.
