KULDEEP SINGH Vs. STATE OF J & K

JUDGEMENT

(1.) This is a petition filed under Section 498 of the Cr.P.C for grant of provisional bail, inasmuch as the petitioner is suffering from a serious ailment, which is required to be treated either at Chandigarh or at Delhi, based upon a medical opinion, given by Dr. Ashok Kumar Sharma (Associate Professor of Eye Department), Government Medical College, Jammu (for brevity, 'the GMC').

(2.) Notice was issued to the official respondents and by virtue of order dated 10.05.2019, directions were issued to the respondents to have the petitioner medically examined in the Police Hospital at Jammu by a specialist in the field.

(3.) As per the learned counsel for the respondents, the examination has been conducted, which can also be seen from the copy of the medical opinion. According to the report, the petitioner is suffering from 'Vitreous Hemorrhage with uncontrolled IOP with loss of vision in his right eye'
