JUDGEMENT

(1.) In these two appeals, a challenge stands laid to the judgment dated 5th of May, 2017 passed by the learned Single Judge in SWP No.2522/2015 clubbed with SWP No.1059/2014.

(2.) It appears that in the selection process conducted for appointment to the post of Lecturer in the discipline of Oral and Maxillofacial Surgery under RBA category in Indira Gandhi Government Dental College, Jammu, Dr. Amrit Pal Singh, (appellant in LPA No.96/2017) was selected. This selection came to be challenged by way of SWP Nos.1059/2014 and 2522/2015 by Dr. Sanjay Kumar Bhagat (private respondent in both LPA Nos.96/2017 and 135/2017) on the ground that the post was required to be considered under the Scheduled Caste category. The aforesaid writ petitions filed by Dr. Sanjay Kumar Bhagat came to be accepted by a judgment dated 5th of May, 2017 whereby the selection of Dr. Amrit Pal Singh came to be quashed.

(3.) This common judgment dated 05th of May, 2017 has been challenged by Dr. Amrit Pal Singh who has filed LPA No.96/2017, and the Department of Health and Medical Education which has filed LPA No.135/2017.
