JUDGEMENT

(1.) PETITIONER challenges the Advertisement notice issued by respondent No. 2 on behalf of respondent No. l published in Kashmir Times On 5.1.1982 whereby application were invited for the post of Principal School of Buddhist Philosophy Leh and seeks a writ of prohibition restraining the respondents from filling the post of principal of School of Buddhist Philosophy Leh on the basis of the said advertisement.

(2.) FACTS lie in brief compass: School of Buddhist Philosophy (Ladakh) in undoubtedly an instrumentality and agency of the State. The school teaches Tibeten and Biddhi. Philosophy, Hindi, Sanskrit, English, Civics , and other subjects from 6th class to Degree level. It also imparts education from primary class to the Monks of the various Monasterise.

(3.) PETITIONER is said to have put in about 18 years of service at the school in various capacities. 1st, he was vice principal for about 5 years, then Administrative officer for about three years and then principal since 1973.
