JUDGEMENT

(1.) CONNECTED Matters OWP No. 683/08 Contempt No. 49/2008, 660/08, 622/08, 816/08, 796/08, 787/08, 750/08, 794/08, 699/08, 641/08, 700/08, 682/08, 730/08, 607/08, 778/08, 592/08, 616/08. Petitioners/institutions are aggrieved of the Government Order No. 386-Edu. of 2008 dated 24-07-2008 under which the respondents have put on hold the grant of 'no objection Certificate' in favour of the petitioners/institutions. The petitioners/institutions approached the Government for grant of 'no objection Certificate' for conducting ETT courses for their Institutions. While their cases for grant of such certificate was under consideration, vide Government Order dated 24-07-2008, which is impugned in the present petitions, the respondents observed as under:-

(2.) THE respondents have filed objections in some of the cases. The learned counsel for the petitioners today submitted that the issue has already been considered by the Srinagar Wing of this Court in OWP No. 631/2008, titled Paras institute of ETT vs. State of J and K and ors. The Court on consideration of the matter, vide order dated 30-09-2008 has set aside and quashed the said order. The Court in the said petition on hearing the parties, has observed as under:-

(3.) IN view of the peculiar facts and circumstances, the learned counsel appearing for the parties have no objections for the disposal of these petitions at this stage. All these petitions are, therefore, disposed of with a direction to the respondent/state and its functionaries to reconsider the cases of petitioners/institutions for grant of non-objection, as prayed by them, un-influenced by the Government Order no. 24-07-2008 and pass appropriate order within a period of two weeks from the date this order is served upon the respondents. All these petitions shall stand disposed of accordingly. Let the copy of this order be placed in each file.
