JUDGEMENT

(1.) The appeal is of the year 2007.

(2.) It is a case of fatal accident.

(3.) The Insurance Company has filed the appeal challenging the award contending that the deceased driving a Maruti Car himself was the reason for the accident in which he died and, therefore, there was no tortfeasor against whom there could be a claim.
