JUDGEMENT

(1.) Petitioner, on the foundation of case set up, seeks following reliefs by issuing a writ:

Learned counsel for petitioner, in support of the case set up by petitioner in writ petition on hand, contends that respondent No. 2 vide Advertisement Notice No. 3 of 2011 invited applications from eligible candidates for engagement as ReT in different Educational Zones of Jammu Districts, which includes one vacancy each for Primary School, Degha and Patyari of Educational Zones, Akhnoor, Jammu. His further contention is that petitioner is the only eligible and meritorious candidate for engagement as ReT in Primacy School Degha being resident of habitation of Degha inasmuch as the population of this habitation is more than 300 souls. He also states that Revenue village Ambaran is a big village, spread over an area of more than 05 kilometres radius and there are six Schools in the village which includes 04 Primary Schools and 02 Middle Schools. Respondent No. 4 is stated to be a resident of habitation Bhamberwah (Amararan) and being outsider has been engaged as ReT in Primary School, Degha in violation to the relevant scheme and policy framed by the Government from time to time and also against the directions contained in the judgment dated 29.05.2012 passed by this Court. Hence, this petition.

(3.) On notice, respondents have filed objections. It is insisted on behalf of respondents 1 to 3 that two posts for engagement of ReT in PS Degha (PS upgraded from EGS) was advertised vide Advertisement Notice No. 03 of 2011. Fourteen applications were received from eligible candidates of the village Ambaran up to the last date, i.e. 16.05.2011. The List, merit Panel and Tentative Panel was prepared and displayed in the village for the general information of the public for seven days. The list, merit and tentative panels were got signed by the VEC of village Ambaran. The same was then submitted to higher authorities for approval. The panel was approved by the Committee at Directorate level and conveyed through Chief Education Officer, Jammu, for engagement of the candidate. The candidate, namely, Anita Chaihal, was appointed and she has joined her duties as ReT in PS Degha.
