JUDGEMENT

(1.) The petition is admitted for hearing. With consent of learned counsel for the parties, the matter is heard finally.

In this petition, the petitioner inter alia seeks a direction to the respondents for quashing the decision of the Screening Committee dated 19.12.2012 by which the case of the petitioner for placement in Selection Grade has been rejected illegally, mechanically and by applying the regulations of 2010 which cannot be applied to the case of the petitioner. The petitioner also seeks a writ of mandamus directing the respondents to promote/re-designate the petitioner as Assistant Librarian Selection Grade w.e.f 05.10.2009 and re-settle and revise the pension of the petitioner and to release the arrears which are due and payable to the petitioner.

Facts leading to the filing of the writ petition briefly stated are that the petitioner joined University of Jammu in the year 1973 as Junior Library Assistant and was promoted as Library Assistant in the year 1981. He was appointed as Assistant Librarian in the pay scale of 2200-4000 pre revised by corresponding reduction of equal number of posts of Professional Assistant vide order dated 05.10.1998. The University of Jammu adopted a career advancement scheme vide notification dated 10.11.2008 and based on the recommendations of the Screening Committee, in its meeting held on 06.04.2010, the petitioner was placed in the Senior Pay Scale of Rs. 10000-325-15200 unrevised which was revised to Rs. 15600-39100 with grade pay of Rs. 7000 after completion of six years of service of Assistant Librarian after regular appointment. The petitioner after completion of five years in the senior scale applied for selection scale, however, the selection committee in its meeting held on 01.02.2011 found the petitioner to be not entitled for placement in the selection grade as per the University Grants Commission Regulations, 2010 and accordingly, rejected his case for placement in the selection grade. In the aforesaid factual background, the petitioner has approached this Court.
