JUDGEMENT

(1.) THE petitioner is a doctor and has qualified MBBS in July, 1971 and M.D. Paediatrics in June 1980. In July, 1985 the Public Service Commission "hereinafter referred to as PSC issued a notification inviting applications for the posts of Lecturers in various Disciplines including the discipline paediatrics. He was interviewed on 6.6.1986 in the office of the PSC at Jammu.

(2.) ALLEGEDLY the PSC forwarded a list of candidates to the Government for filling in four posts of Lecturers in Paediatrics. Nothing was done by the Government till 1989, when again a notification came to be issued by the PSC on 28.12.1989 inviting applications for the posts of Lecturers in various disciplines including the discipline of Paediatrics. The petitioner did not apply afresh, as according to him the previous notification was neither repealed and not superseded by the subsequent notification.

(3.) THE petitioner has challenged the subsequent notification interalia on the following grounds: -
