JUDGEMENT

(1.) PETITIONERS numbering 17 here -in -above have filed this writ petition way back in the year 1988 and is numbered as SWP No: 1216 of 1988 alongwith CMP No: 3050 of 1988.

(2.) THE petitioners claim in the petition is that they being employed as teachers in the Education Department of the State and are possessing B. SC and B. Ed qualifications and have been appointed on the dates spelt out in annexure -PI (showing appointment to the posts on different dates of seventeen teachers the petitioners are shown ranging from 4 -12 -1S68 to 31 -3 -1978) and claim that as because about 200 posts of Science teachers in various schools beginning from 1976 have been created and the posts as per their claim have not been filled till date either by direct recruitment or by promotion from the in service teachers.

(3.) THE petitioners further project in the petition that in terms of SRO 240 dated 23 -4 -1979 called the Jammu and Kashmir Educational (Subordinate) Service Recruitment Rules of 1979, hereinafter referred for short, as the Rules of 1979, the posts of the Masters are to be filled as:
