JUDGEMENT

(1.) DARSHAN Singh in this petition Under Article 226 of the Constitution of India read with Section 103 of the Constitution of Jammu and Kashmir challenges the detention of Charanjit Singh his son lodged in the District Jail, Udhampur, under the J&K Public Safety Act, 1978. The District Magistrate, Jammu, passed a detention order against him and served it on Charanjit Singh "here -in -after called the detenue" Under Section 8 of the J&K Public Safety Act "here -in -after called the Act", on various grounds. The grounds mentioned therein, are, as follows: -

(2.) YOU Shri Charanjit Singh alias Dimple S/o Darshan Singh R/o H. No.: 201 Sector No. II Nanak Nagar are affiliated with the ASSIF and have a liaison with the extremists of Punjab who are posing a threat to the integrity of the country through terrorist and violent means for the creation of the so called Khalistan. You had been to Pakistan for obtaining training in armaments and to bring a consignment of arms and ammunition for further supply to the militants of Punjab.

(3.) ON 4 -2 -91, you in the company of S/Shri Ajit Singh alias Billa S/o Mian Singh R/o Miran Sahib, Amar Singh Alias Fauji R/o Punjab and Darshan Singh S/o Ajit Singh R/o Nari (Tehsil R.S. Pura) started a journey to Pakistan for being trained in arms and subversion and to bring arms and ammunition in order to supply the extremists of Punjab who are engaged in terrorist activities with a view to create the so called Khalistan.
