JUDGEMENT

(1.) THIS revision is directed against an order dated 1.12.1977 passed by the Sessions Judge, Anantnag, dismissing a criminal revision for default of the petitioner.

(2.) COUNSEL for the respondent conceded that even if the petitioner had remained absent, the court was bound to consider the matter and dispose of the revision petition on merits. In the circumstances, the impugned order is set aside and the Sessions Judge, is directed to re -hear the revision petition and dispose of the same on merits,

(3.) THE parties are directed to appear before the Sessions Judge, Anantnag, on 11th of September, 1982.
