(1.) The petitioner is aggrieved of and has called in question notification bearing no. SIMS. 302 07 (XXXVIII)/2022-2690-99 dtd. 25/8/2022 issued by Additional Director, SKIMS. and Ex-officio Secretary to Government, whereby the petitioner has been declared ineligible for promotion to the next higher post/grade under Assessment Merit Promotion Scheme (AMPS). It is found that the petitioner lacks the requisite service of 5 months and 8 days as per the AMPS and is also falling short by two indexed publications.

The entire edifice of the petitioner's case is built on the plea that he is entitled to retrospective effect to his appointment as Assistant Professor in the discipline of Clinical Haematology and that way he would acquire the requisite eligibility for promotion to the next higher post/grade of Associate Professor in the said discipline.

Briefly stated, the facts as projected by the petitioner in this petition are that pursuant to notification no. 04 of 2015 dtd. 10/7/2015 issued by SKIMS. for making selection of Assistant Professors in various disciplines including the discipline of Clinical Haematology, the petitioner being eligible also submitted his application for the post of Assistant Professor Clinical Haematology. The respondent Institute took almost 4 years to complete the selection process and appointed the petitioner vide government order number 106-SKIMS. of 2019 dtd. 27/11/2019.
