JUDGEMENT

(1.) FOR the reasons stated in the application the delay of 235 days in filing the appeal is condoned, particularly when there is no serious objection raised by Mr. Shukla.

(2.) CONDONATION application stands disposed of.

(3.) THE instant appeal filed under Clause 12 of the Letters patent is directed against the judgment and order dated 03.04.2008 rendered by the learned Single Judge of this Court in SWP no. 333 of 2005 by holding that posts of Excise Guard could not be included in the advertisement notice issued by the appellants because the directions issued by this Court on
