JUDGEMENT

(1.) Petitioner has sought quashment of the communication bearing No. Health/79/NG/2007 dated 11th December, 2007, made by respondent No. 4-Under Secretary to Govt. Health and Medical Education Department, to respondent No. 2-Secretary J&K Service Selection Recruitment Board, Srinagar/Jammu. Petitioner further seeks writ of mandamus to the effect that respondent No. 2 be directed to forward the name of petitioner to the Govt. for his appointment against the post of Ophthalmic Assistant and release the consequent benefits thereof.

(2.) Respondents 1 to 4 have filed the reply and resisted the petition.

(3.) Respondent No. 5 has chosen to remain absent, accordingly has been set exparte.
