Petitioner, through the medium of instant petition, has challenged communication No.F(Merit)Tab/KU/2014 dated 11.04.2014, whereby his representation for award of Gold Medal in his favour has been rejected. Challenge has also been thrown to notification No.F(Award)- Gold-MC.MBBS/Acad/KU/12 dated September 11, 2012, whereby decision was taken by the authorities of University of Kashmir, to authorize award of Gold Medal in MBBS and BDS courses on the basis of aggregate merit obtained by the candidate from 1 st Professional to final Professional examination and effect of the said decision was given from the conduct of last convocation onwards.

It is the case of the petitioner that he had qualified his professional degree of MBBS in Session July-August, 2010 and had secured 580 out of 900 marks in the final year examination of MBBS thereby securing first rank. According to the petitioner, on account of his merit, he was entitled to be awarded Gold Medal and Gold Medal Certificate in terms of the University Rules in vogue in the year 2010.

It is averred that in the year 2010 and 2011, the University did not conduct convocation and, as such, petitioner was not handed over Gold Medal and Gold Medal Certificate during these years but when the convocation was held in the year 2012, he was not awarded Gold Medal and the certificate despite having secured first position in the final year MBBS examination.
