JUDGEMENT

(1.) THIS is a complaint filed under Section 17(a)(i)of the Consumer Protection Act, 1986 .

(2.) THE factual matrix leading to the filing of this complaint is set out as hereunder.

(3.) THE complaint is filed on behalf of the minor girl by the father of the complainant, being a natural guardian. The complainants are residents of D. No. 36 -46 -46. The second complainant is a bright student and always stood first in the class right from her first standard and also equally bright in games and sports. She completed her 9th standard and was promoted to 10th standard. The house of the complainants was re -modelled due to widening of the road in the year 2001 and the current wires of the opposite parties are almost touching the house on the top in the process of shifting. The previous poles were moved and new poles were fixed by the Deputy Executive Engineer concerned and their staff and at the time of installation of the new poles itself, the father of the complainant insisted to use plastic pipes as the wires are touching the first and second floors of the house of the complainant. But the opposite parties did not respond and the first complainant gave several complaints during the years 2001 and 2002 to the Deputy Executive Engineer, A.P. Transco, Visakhapatnam and Assistant Engineer, Visakhapatnam to remove the wires as they are touching the balcony and are dangerous to human life but the opposite parties never acted upon the representation. On 4.5.2002 when the second complainant and her brother and other children of their relatives were playing in the second floor, the current H.T. wires came into contact with the second complainant and she was electrocuted due to passing of current. Because of shock, she fell down at a distance and her legs and right hand were brunt. Immediately the first complainant took her to the nearest hospital and the doctors removed her right hand completely and also fingers of both the legs. She had also received grievous and simple injuries on the body and her nervous system was also affected and has been lying in bed from the date of this incident till now and her life became miserable.
