JUDGEMENT

(1.) HEARD learned counsel for the petitioner and the counsel appearing for the University.

(2.) Petitioner has filed this writ application for quashing the order dated 30.3.2009 issued by the Registrar, B.R.A. Bihar University on behalf of Vice -Chancellor of the University, informing the petitioner that he has been superannuated from service with effect from 31.7.2006 as has completed 44 years of his service on 31.7.2006. By the impugned order, a direction has also been issued for recovery of excess emoluments drawn by him beyond 31.7.2006.

PETITIONER 'scase is that initially he was appointed in the Bihar University, Muzaffarpur on 1.4.1976 alongwith other permanent Grades -Ill & IV grade employees, his services were confirmed on 5.9.1980. Thereafter, he was transferred and posted as an Assistant in the P.G. Department of Chemistry. From P.G. Department, he was transferred to R.G.B.R. College, Maharajganj as an Assistant vide order of the Vice -Chancellor, dated 14.1.1981. Finally, by order dated 17.7.1982, he was transferred to L.S. College, Muzaffarpur on the post of Assistant and before issuance of the impugned order, he was working as an Assistant in LS. College, Muzaffarpur.
