EMPLOYEES IN RELATION TO MANAGMENT OF JAMADABA OF TATA IRON AND STEEL CO LTD Vs. PRESIDING OFFICER CENTRAL GOVERNMENT INDUSTRIAL DISPUTES TRIBUNAL CUM LABOUR COURT

Decided On July 08, 1988
TATA IRON AND STEEL CO. LTD., JOMADOBA Appellant
V/S
PRESIDING OFFICER, CENTRAL GOVERNMENT INDUSTRIAL DISPUTES TRIBUNAL-CUM-LABOUR COURT NO. 1, DHANBAD Respondents

JUDGEMENT

(1.) This writ petition is directed against an award dated 14-4-1977 passed by the Respondent No. 1 in Reference Case No. 14 of 1975 and as contained in Annexure-2 to the writ petition whereby and whereunder the respondent No. 1 answered the reference in favour of the workmen and against the management.

(2.) The facts of the case lie in a very narrow compass and are not much in dispute. The petitioners-company had six coal mines in Jharia coalfield region namely, (I) Digwadih (2) Malkera (3) Behlatand (4) Sijua (5) Jamadoba (3 and 4 pits) and (6) Jamadoba (6 and 7 pits). It is alleged that the Behlatand colliery has since merged with Sijua colliery as a result whereof the number of collieries has been reduced to five in the said region.

(3.) According to the management-petitioner each colliery has an independent accounts-section which is under the charge of a clerk known as accounts- incharge. However, the employees of the aforementioned collieries are under the overall control and subordination of an officer called the Divisional Manager (Collieries).
