(1.) HEARD learned counsel for the parties.
(2.) PETITIONER is the widow of late Basudeo Singh. Other issue was sorted out. Since she has not received the G.P.F. of her late husband after retirement in the year, 1994 for a long period of time she filed the present writ application. It seems that the authority woke up to the claim of petitioner only after filing of the writ application. They worked out a sum of Rs. 19,470.00 as the payable amount to petitioner and payment by way of draft dated 6.9.2006 was made. Learned counsel for the petitioner however makes a grievance that the respondents sat over this amount for more than 12 years and in that view of the matter she is entitled to be compensated by way of grant of interest right till the date of payment of this amount. There is no explanation in the affidavit which has been filed on behalf of the State as to why took them so long to make payment of the G.P.F. amount of her husband.
(3.) IF this is the position then learned counsel for the petitioner seems to be correct in stating that the respondent Provident Fund authority cannot be allowed to draw advantage of their own inaction.
