JUDGEMENT

(1.) IN this writ application prayer of the petitioner is for a direction to the Bihar School Examination Board and its authority to correct her date of birth in the original certificate of matriculation. In the matriculation certificate the date of birth of the petitioner has been mentioned as 5.11.1969 in place of 5.11.1970. In support of her claim the petitioner has annexed photocopy of admit card issued by the Bihar School Examination Board for the purpose of appearing in the examination. In this admit card the date of birth of the petitioner has been mentioned as 5.11.1970. Petitioner appeared in the examination conducted by the Board in the year 1985 and after much delay she filed her application for correction of her date of birth.

(2.) IN the counter affidavit filed by the respondent, objection has been raised regarding the delay on the part of the petitioner for the purpose of making correction in the date of birth. Regarding the admit card also it has been stated that it is not in original and the some doubt has also been raised so far photocopy is concerned by stating that there is over -writing. However, in paragraph 9 of the counter affidavit it has been stated that though the claim of the petitioner is too old but the Deputy Secretary of the Board has decided to verify the relevant records and for that letter has been sent to concern school for producing the original documents/records i.e. Original Admit Card, Original Registration Slip, Original Admission Register and Original Transfer Certificate, guard file and original affidavit with regard to whether the petitioner is in service or not. Reminder letter has also been issued to Headmistress of the concerned school. No counter affidavit has been filed by the Headmistress/Headmaster of Krishna Dhari Kedar Nath High School, Kharka, District Sitamarhi.

(3.) WITH the aforesaid direction/observation this application is disposed of.
