(1.) HEARD the parties.

THIS MJC petition has been filed by the State of Bihar seeking extension of time for disposal of the matters remanded by judgment and order dated 26.6.2006 passed in LPA No. 946 of 2003 and analogous cases as well as in MJC No. 3172 of 2006 disposed of on 19.1.2007. Now, the learned counsel for the State has taken a stand that the final decision required to be taken by the State Government has already been taken and no further time is required. In other others, the State now does not seek any extension of time because according to learned counsel for the State, all the required action has already been taken. Learned counsel for the writ petitioners have pointed out that approximately 245 matters have been kept pending by the State Government and no final decision has been taken in those matters as yet and this amounts to violation of the order of this Court. The stand of the learned counsel for the State is that decision in those cases could not be taken on account of certain necessities and compelling reasons and if a petition for contempt is filed in respect of those matters, the State would be ready to give a suitable reply. On behalf of the writ petitioners a large number of other grievances were sought to be raised against the final decision taken by the State Government as indicated in the supplementary affidavits on behalf of the State.
(3.) THIS MJC relates only to the prayer of the State for extension of time as indicated in the LPA judgment. In this proceeding it is not deemed possible to look into the grievances of the writ petitioners and according to submissions of learned counsel for the State, this MJC petition has to be now dismissed as infructuous. This MJC petition is accordingly dismissed as infructuous.
