(1.) THE petitioner in this application seeks to challenge the decision of the respondent authorities not to provide him with a Government job on compassionate grounds following the death of his father while in Government employment.
(2.) THE admitted position is that the petitioner's father died in the year, 1982. At that time the petitioner was a minor. He attained majority in the year, 1991 that is, after about nine years from the date of death of his father. Following the death of the petitioner's father, the petitioner's mother made an application claiming a job not for herself but for her minor son. At that time naturally no job could be given to the petitioner as he was merely a young boy. The claim was re -asserted after the petitioner had attained majority. The respondent authorities rejected the claim on the ground that it was very stale and the petitioner's father had died long ago.
(3.) MR . S.S. Asghar Husain, learned counsel appearing on behalf of the petitioner relied upon the Government circular dated 5.10.1991 which has done away with any time limit for filing an application for appointment on compassionate grounds and submitted that in view of that circular, the decision of the respondent authorities was unreasonable, arbitrary and unsustainable.
