SUBODH KUMAR SINGH Vs. STATE OF BIHAR

Decided On July 27, 2006
SUBODH KUMAR SINGH Appellant
V/S
STATE OF BIHAR Respondents

JUDGEMENT

(1.) A second supplementary counter affidavit has been filed on behalf of respondent no. 9 wherein it has been stated that the encroachment within the premises of the school has been removed. Now there is no encroachment or unauthorised occupation within the school premises. Counsel for the petitioner also does not dispute the fact. ¢ However, it requires constant vigil so that no unauthorised person may enter into the premises or occupy the premises. For the said purpose the district administration shall take steps and, if possible, provide security ensuring that no property of the school is misutilised or encroached. Learned counsel for the petitioners, however, stated that there is a space within the premises of the school and, as such, direction be given for construction of the quarters for the Principal/teachers so that the property of the school be saved and if it is constructed it would be useful for the administration also. In this regard it would be proper that the petitioners, if so advised, approach the competent authority for redressal of the grievance. Since the encroachment has been removed, there is no need of keeping such matter pending before this Court.

(2.) ACCORDINGLY , this writ petition is disposed of with the direction/observations, indicated above.
