(1.) IN this M.J.C. application, prayer is to initiate contempt proceeding against Opposite Parties for alleged wilful violation of the order of this Court dated 23.3.2004 passed in C.W.J.C. No. 5267 of 2000 (Most. Ushafo Kunwar V/s. The State of Bihar and Ors.).
(2.) THIS Court vide order dated 8.3.2006 initiated contempt proceeding against the Opposite Parties and directed them to file show cause and also for their personal appearance. Pursuant to the said order, the Opposite Parties appeared and tiled their show cause on 20.3.2006. However, as there was discrepancy in the calculation of the amount of interest which is also admissible besides the family pension as mentioned at page 27 of Annexure -G was not included while calculating the interest as per direction of this Court, this Court on the prayer made on behalf of Opposite Parties adjourned the matter and meanwhile directed the Opposite Parties to see that proper calculation is done and cheque for the remaining amount of interest, if any, is found payable, must also be produced on the next date. in the facts and circumstances, personal appearance of the Opposite Parties was dispensed with. A supplementary show cause has been filed on behalf of District Superintendent of Police, Burdwan (Opposite Party No. 6). Learned counsel appearing for the Opposite Parties has produced a cheque of Rs. 42,028/ - issued in favour of the petitioner for payment of her remaining dues of interest, which has been handed over to the learned counsel for the petitioner.
(3.) IN the facts and circumstances aforementioned, the apology tendered by the Opposite Parties is accepted and contempt proceeding initiated against them is hereby dropped. M.J.C. application is, thus, disposed of.
