(1.) Heard Mr. Alok Kumar Agrawal, learned counsel appearing on behalf of the petitioner and Mr. Madhu Prasun, learned counsel appearing on behalf of the respondents.

The petitioner has filed the present writ petition under Art. 226 of the Constitution of India assailing the validity and correctness of the orders/communications, both dated 23.12.2010, as contained in Annexure-12 and 12/A to the writ petition, issued under the signature of the respondent no.3, whereby the claims raised on behalf of the petitioner have been mechanically rejected by cryptic orders.
(3.) It is not in dispute that the petitioner had moved earlier before this Court in C.W.J.C. Nos. 5112 of 2009 and 5166 of 2009 challenging the actions/orders of the respondent East Central Railway and its functionaries, which were prejudicial to the petitioner. Both the writ petitions were heard together and were disposed of by a common order dated 11.01.2010 (Annexure-9). The orders passed by the authority of the respondent East Central Railway were set aside and quashed, and the matters were relegated to the respondents for passing a fresh order in accordance with law after giving an opportunity of hearing to the petitioner. The impugned orders/ communications have been passed in view of the aforesaid remand order.
